Taiwan Indicts 9, Including Nvidia and Super Micro Staff, in First AI Chip-Smuggling Crackdown

Taiwan's Keelung District Prosecutors Office indicted nine individuals on August 25, 2026 — including an Nvidia Taiwan employee surnamed Chang and two Super Micro Taiwan employees — for allegedly conspiring to smuggle high-end Nvidia-equipped AI servers to China in violation of US export controls in place since 2022. Prosecutors said the group created false end-user documents claiming 130 B300-based servers would remain in Taiwan, then exported 74 of them to Chinese customers via direct shipment and transshipment through Japan, Indonesia and Hong Kong; a further 56 servers destined for export were intercepted by Taiwanese customs. Eight defendants face breach-of-trust and document-forgery charges; a ninth was charged in a related case involving alleged fund-siphoning from a distributor. Prosecutors said the defendants 'colluded with one another at various levels for enormous profit, illegally exporting high-end servers, increasing corporate compliance costs, and severely damaging our nation's international image.' The case builds on a Super Micro-linked investigation that began with raids and detentions in July 2026. Nvidia said it has 'every incentive to work diligently with customers to ensure compliance with all applicable laws'; Super Micro said it is cooperating with authorities and has not been accused of wrongdoing.
