Russia Submits ICJ Memorial Appealing ICAO's MH17 Reparations Ruling
On June 29, 2026, Russia submits its written Memorial to the International Court of Justice (ICJ) in its appeal against the ICAO Council's June 30, 2025 ruling that Russia is responsible for downing MH17. Russia initiated the ICJ case — 'Appeal from the ICAO Council decision dated 30 June 2025 (Russian Federation v. Australia and Netherlands)' — on September 18, 2025, after refusing to respond to Australian and Dutch notes verbales requesting the good-faith reparations negotiations that ICAO had ordered. In its Memorial, Russia claims to present evidence that the ICAO ruling was 'unsound' and reiterates objections to the Council's finding of state responsibility. The ICJ has set January 29, 2027 as the deadline for Australia and the Netherlands to file their Counter-Memorial. The filing marks Russia's latest avenue to avoid the reparations negotiations ICAO ordered after finding Russia breached the Chicago Convention by deploying the Buk missile system that destroyed the aircraft.
