Israeli High Court Gives Netanyahu Government 2-Month Extension to Decide on October 7 State Inquiry

Israel's Supreme Court (High Court of Justice) declined on April 27, 2026 to order the government to establish a state commission of inquiry into the October 7, 2023 Hamas attack, instead granting the government a two-month extension (until approximately late June 2026) to decide how to investigate the failures. The ruling followed a dramatic hearing on April 23 at which pro-government activists attempted to storm the courtroom — police said they were investigating the incident — and in which justices expressed astonishment at the government's position that a probe should wait until 'after all wars are won.' Government attorney Michael Rabello argued the court lacked authority to compel establishment of a state commission of inquiry and that 'the time is not yet ripe.' Justices were highly critical but divided over whether to force the government's hand before upcoming elections. Opposition leader Benny Gantz vowed to establish a probe immediately upon forming a government. Bereaved October 7 families attending the hearing clashed with pro-government activists outside the courtroom. The decision defers the most consequential accountability question since October 7 to after Israel's next election cycle.
