Electoral Chamber Strikes Down Milei's Citizenship Decree
Argentina's National Electoral Chamber declared Emergency Decree 366/2025 unconstitutional, voiding Milei's attempt to transfer authority over naturalization from the federal judiciary to the executive branch's Immigration Directorate. The court ruled that citizenship — which confers voting rights — is a matter reserved for Congress, not presidential decree, ending a 150-year-old judicial role in citizenship grants that Milei had sought to bypass. It is the latest in a string of judicial setbacks for Milei's strategy of governing via emergency decree (DNU) rather than legislation.
