Trump Reshapes Board of Immigration Appeals, Immigration Court Backs DHS in 20 of 21 Decisions
NPR reported on March 20, 2026 that President Trump has slashed the number of members on the Board of Immigration Appeals (BIA) and stacked it with administration-aligned appointees, sharply limiting due process options for immigrants. In 2026, NPR tracked 21 BIA decisions — DHS won all but one. The BIA also ruled in Matter of Yajure Hurtado that immigration judges must deny bond and detain noncitizens who entered illegally. EOIR instructed immigration judges to follow this precedent even as multiple district courts have rejected mandatory detention as policy.
